Welcome to Bhumisetu Holidays Private Limited. These Terms and Conditions govern your use of our services, including holiday packages, villa sales/rentals, plot purchases, and profit-sharing programs. By making a booking, payment, or using our services, you agree to be bound by these terms. Please read them carefully.

1. Booking and Payment

1.1. Booking Process: To book a holiday package, villa rental/sale, plot, or participate in our profit-sharing program, you must provide accurate information through our website or customer support team.

1.2. Payment Methods: We accept payments via credit/debit cards, bank transfers, and other methods specified at the time of booking. Full payment or a deposit (as specified) is required to confirm your booking.

1.3. Confirmation: Upon successful payment, you will receive a booking confirmation via email. It is your responsibility to review the details for accuracy.

2. Cancellation and Refund Policy

We understand that plans may change. Our cancellation and refund policies vary by service type:

2.1. Holiday Packages

  • More than 30 days before departure: 10% cancellation fee.
  • 15–30 days before departure: 25% cancellation fee.
  • Less than 15 days before departure: Non-refundable.
  • Refunds will be processed within 15 business days, subject to third-party fees (e.g., airline or hotel charges).

2.2. Villa Rentals

  • More than 60 days before check-in: No cancellation fee.
  • 30–60 days before check-in: 50% cancellation fee.
  • Less than 30 days before check-in: 100% cancellation fee.

2.3. Villa Sales

  • Cancellations are subject to the terms of the purchase contract. Bhumisetu Holidays does not guarantee refunds for villa sales cancellations.

2.4. Plot Purchases

  • A non-refundable percentage (as per the sales contract) will be retained upon cancellation.

2.5. Profit-Sharing Program

  • Participants must adhere to the profit-sharing agreement terms. Withdrawals may incur a processing fee, and payouts are subject to program conditions.

2.6. No-Show Policy: Failure to show up for a booked service without prior cancellation will result in a 100% charge with no refund.

3. Travel Insurance

We strongly recommend purchasing travel insurance to cover unforeseen events such as trip cancellations, medical emergencies, or loss of belongings. Bhumisetu Holidays is not responsible for losses not covered by insurance.

4. Client Responsibilities

4.1. Accurate Information: You are responsible for providing accurate information at the time of booking, including travel documents (e.g., passports, visas).

4.2. Compliance: You must comply with all travel regulations, including visa requirements, health protocols, and destination laws.

4.3. Conduct: You agree to behave responsibly during travel or while using our properties. Any damage caused to villas or other properties will be charged to you.

5. Liability and Indemnification

5.1. Limitation of Liability: Bhumisetu Holidays is not liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or personal injury, arising from the use of our services.

5.2. Third-Party Services: We are not responsible for the actions, omissions, or failures of third-party providers (e.g., airlines, hotels, tour operators).

5.3. Force Majeure: We are not liable for delays, cancellations, or damages due to events beyond our control, such as natural disasters, political unrest, or pandemics.

5.4. Indemnification: You agree to indemnify Bhumisetu Holidays against any claims, damages, or losses arising from your breach of these terms or misuse of our services.

6. Governing Law and Dispute Resolution

6.1. These terms are governed by the laws of India.

6.2. Any disputes arising from these terms or your use of our services will be resolved through arbitration in Mumbai, Maharashtra, India, in accordance with the Arbitration and Conciliation Act, 1996.

7. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the updated terms.
